Mr. Perry  (the plaintiff) is seeking an award of  $1,000 statutory damages for each violation and punitive damages.

Mr. Perry alleges that the debt collector harassed him by calling his work and cell phone.  The debt collector threatened to run Mr. Perry’s credit report without his authorization which could be a violation of the Fair Credit Reporting Act (FCRA).

  • Complaints of Debt Collectors using obscene language is up 35%
  • 2,517 incidents of a threat or actual use of violence by Debt Collectors
  • 9,632 complaints, asserted that collectors demanded interest, fees, or expenses that were not owed (such as collection fees, late fees, and court costs)

What’s more shocking is that complaints about Debt Collector Harassment are set to rise another 13% in 2010.
