Debt Collectior Loses $5,085 In Court

August 5th 2oo8. Cedric and I entered the Contra Costa County Courthouse. We were first on the Docket. Cedric Darrett vs. Attorney Collection Services. We were prepared and no where near scared.

Everyone else round us seemed nervous. Not us. We were almost giddy. One man sitting outside the Courtroom angrily blurted out in our direction, “you guys act like you do this all the time!” I smiled and looked the gentleman in the eye and replied we do.

The Bailiff was the mainstream image of a California Woman. She unlocked the Courtroom doors and pulled each one back with authority. This was her Courtroom, she was the guardian – no questions.

Shortly after Cedric and our team was seated, a Court Appointed Mediator entered the Courtroom. She proceeded directly to the front of the Courtroom and introduced herself. She asked if anyone wanted to try to resolve the matter without appearing in front of the Judge. Cedric and I disagreed as did everyone in the Courtroom.

It was 1:15 pm Pacific Time when the Judge entered from his Chamber. The Bailiff stated “all rise”. Then she instructed us to place our right hands and pledge to tell the truth. We did. We sat Down and the Judge called for Cedric Darrett vs. Attorney Collection Services. I had helped Cedric prepare his case and was confident of a win.

Cedric Darrett made his case to the Judge. The Judge informed Cedric that he was aware of the FDCPA and FCRA and how to enforce those laws. I smiled because defeating this Debt Collector was just too easy 🙂 The Judge listened and looked at all of Cedric’s evidence. The Judge seemed perplexed that any business would violate the Law so brazenly.

The Judge stated to Mr. Darrett “you’ll recieve your Judgement in the mail in about two weeks.” That was it. We won! The Debt Collector lost.

Judgement: $5,085

Cedric Darrett informed me that he was awarded $5,085 (that’s five thousand and eighty five dollars). Below is Cedric Darrett in the Motel – ironically across the street.
